A memorial of an indented deed of release dated the twenty sixth day of March one thousand seven hundred and seventy seven and made or men… to be made

between Charles North of Cottage or wise Davidstown in the county of Westmeath and Richd North Ensign in his majesty’s fifteenth regiment of foot of the one part

and Isaac Augustus D Arripe of Portarlington in Queens county esqr of the other part

whereby

after reciting

that by a deed of lease dated about the seventh of April one thousand seven hundred and fifty eight [1758 190 487 127789]and made between Henry Pilkington of Toar in the county of Westmeath esqr and Abraham Pilkington of Killbeggan in the said county esqr of the one part and Roger North of Newcastle in the said county gent of the other part the said Henry and Abraham Pilkington for the consideration therein mentd demised to said Roger North all that and those the town and lands of Davidstown situate in the county of Westmeath therein and herein after more particularly described and mentd to  hold to the sd Roger his heirs and assigns from the first of Novr then last for the life and lives of Chas North Susanna North and Richd North two sons and  daughter of sd Roger North at and under the yearly rent of five shillings payable half yearly as therein mentd

and that by deeds of lease of and release the release dated about twenty sixth of April one thousand seven hundred and fifty seven and made between Judge Rochfort of Streamstown in the county of Westmeath esqr of the one part and the said Roger North of the other part the said Judge Rochford for the considerations therein mentd demised to said Roger North all that and those the town and lands of Lisaura [sic - otherwise Lisarra] situate in the barony of Moycashell and county of Westmeath aforesd therein and herein also after particularly described and mentd to hold to sd Roger North his heirs and assigns from first of May then next for lives and life of Ulysses North Joseph North and Chas North three sons of said Roger North at and under the yearly rent of ten pounds sterg payable half yearly as therein mentd and that in said deed of release there was contained a covenant for perpetual renewal on paymt of a proportion on the fall of each life

[Not mentioned in this deed, but it would seem quite relevant, is deed 1757 185 553 124252, also of 26 April 1757, in which Roger North conveys the land of Lisarra, 72 acres, to Robert Rochford, from 1 May next for terms of lives renewable forever, witnessed by Judge Rochford.] 

and also after reciting that by deeds of lease and release the release dated about second day of March one thousand seven hundred and fifty eight and made between sd Judge Rochfort and William North of Clonfad in the said county of Westmeath esqre after reciting the last mentd deeds the sd Judge Rochfort for the considns therein mentd demised to sd Wm North all that and those the therein and herein last mentd lands and premes [i.e. Lisaura] to hold to said Wm North his heirs and assigns for ever subject to the sd therein and herein before in part recited deed of release of twenty sixth April one thousand seven hundred and fifty seven at the yearly rent of four pounds payable half yearly as therein mentd [this might be the deed recorded in 1758 190 488 127791, though that memorandum has no date for the deed, is for a different rent, and makes no mention of Roger North]

and also after reciting that the sd therein last recited deeds of lease and release were executed by the sd Judge Rochfort to the sd Wm North in trust for the sd Roger North his heirs and assigns [this may be an assertion being made after the event, not recorded in the earlier deeds themselves; but it would make sense if the substantive original transaction was from Judge Rochfort to Roger North, and all subsequent legal transactions were effectively in trust for Roger's substantive benefit - though for exactly what reasons one can't guess: the usual general reason being to keep at least one step ahead of one's creditors.]

and also after reciting that by one other deed dated abt twenty eight July one thousand seven hundred and forty eight and made between Gusts Lambert of Stockallon in the county of Meath esqr and Abraham Sterling of Killbeggan in county of Westmeath dealer the sd Gustavus Lambert for the considns therein mentd demised to said Abraham Sterling all that and those the house and garden on the north side of the street of Killbeggan then late the property of Wm Sterling deced and other the premes therein and herein after more particularly described and mentd situate in the Barony of Moycashell and county of Westmeath aforesaid with the appurces to hold to sd Abraham Sterling his heirs and assigns from first of May then last past for the lives and life of him the said Abraham Sterling John Gibbons and Sterling Gibbons nephews to the said Abram Sterling at the rent of six pounds and eighteen shillings with six pounds…. receivers fees

and also after reciting that the said Abrm Sterling by an indr bearing date abt the fourteenth of April one thousand seven hundred and fifty did for the considns therein mentd sell assign and make over to said Roger North all his the said Abraham Sterling’s right title and interest in and to his last mentd deed and the premes thereby demised

and also after reciting that said Roger North now deced but before his death made his will dated twenty fourth Febr one thousand seven hundred and sixty four and thereby amongst other things demised to his said son Chas North all his estate and ints in and to the lease of sd lands of Davidstown and to his sd son Richd North all his estate and interest in and to the his other lease of the lands of Lisaura and premes in and about Killbeggan

the sd Chas and Richd North for the considns in sd deed of release of which this is a meml did grant release and confirm unto the said Isaac Augustus D Arripe all that and those the town and lands of Davidstown contg one hundred acres be the same more or less situate lying and being in the Barony of Fartullagh and county of Westmeath aforesd

and also all that and those the town and lands of Lisaura containing by estimation twenty two acres by the same more or less situate lying and being in the Barony of Moycashell and county Westmeath aforesd

and also all that the those the house and garden on the north side of the street of Killbeggan late the property of Wm sterling deced also the field in halls farm contg three acres two roods and twenty five perches plantation measure be the same more or less also the field in the pound commonly called the long part contg six acres ten perches plantation measure be the same more or less toger with one acre and thirty eight perches of reclaimed bogg all late in the possion of the sd Wm Sterg deced situate lying and being in the Barony of Moycashell and county of Westmeath aforesd toger with all and singular the rights members and appurtes thereunto belonging in as full and ample manner as the same was granted by the sd sevl herein before recited deeds and the  ren… and ren.. rem… and rem... yearly and other the rent issues and profits thereof

and all the estate right title interest benefit of renl property claim and demd whatsr both at law and in equity of them the said Chas North and Richd North of in and to the sd lands and premes and every part and parcell thereof together with the sd sevl therein before recited deed and all other deeds and writings relating to the premes in the custody or power of the sd Chas North and Richd North or either of them with the app… to the said Isaac Augustus D Arripe his heirs and assigns during the life and lives of the sevl persons named in the therein recited deeds and survivors and survivor of them and for and during the lives and life of such other person & persons as shd from time to time for ever hereafter be added to the term of sd deed of twenty eight April 1757 pursuant to the covt for renewl for ever therein mentioned subject as therein mentd

and subject also to a provisoe or condition of redemption therein contd on paymt of the sum of four hundred & thirty three pds six shillings… … and interest therein mentd

which sd deed of which this is a meml and this meml are witnesssed by Thomas Plunkett ….. and Wm Pilkington both of the city of Dublin gents
