Transcription:

A memorial of an indented deed of lease bearing date the eighth day of November one thousand seven hundred and seventy nine between

Abraham Pilkington of Toar lodge in the county Westmeath esqr and Henry Pilkington of Toar in said county Westmeath eldest son and heir apparent of the said Abraham Pilkington of the one part and

Charles North of Cottage otherwise Davidstown in said county gent of the other part

which said deed recites that

whereas by indenture of lease [1758 190 487 127789] bearing date the seventh day of April one thousand seven hundred and fifty eight and made between Henry Pilkington then of Toar in said county esqr since deceased father of said Abraham and said Abraham of the one part and Roger North then of Newcastle in said county gent since also deced of the other part said Henry and Abraham for the considerations mentioned did demise and sell unto the said Roger North all that the town and lands of Davidstown situate in said county to hold to the said Roger North his heirs and assigns for three lives therein named and the survivors and survivor of them at the yearly rent of five shilling payable half yearly

and whereas by an indented deed [1758 190 488 127790] bearing date the seventh day of April one thousand seven hundred and fifty eight and made between the parties aforesaid said Henry and Abraham Pilkington for the considerations therein mentd did give grant and make over unto said Roger North a yearly rent charge of sixty pounds chargeable upon the lands of King sityate in said county to hold to said Roger North his heirs and assigns for lives therein named and the survivors of them

and also whereas said Roger ... made and published his last will and testament in writing and thereby ... the said herein before indenture of lease and charge unto his son said Charles North party hereto as by said will appears.   

Now the said indenture witnesseth that

the said Abraham Pilkington and Henry Pilkington

for and in considn of the said Charles North’s surrendering said indenture of lease and rent charge unto said Abraham Pilkington or Henry Pilkington

do hereby demise unto said Charles North his heirs and assigns all that and those the town and lands of Davidstown now in the possession of said Charles North containing ninety five acres be the same more or less situate in the Bary of Fartullagh and county Westmeath together with all houses buildings and improvements now erected and made thereon

to hold said lands and premes unto said Charles North his heirs and assigns from first day of May last past for and during the natural life and lives of said Roger North, Philip North and Charles North and the survivors and survivor of them and each of them and for and during the life and lives of all and every such other person or persons as shall from time to time for ever be added by virtue of a covt for renewal for ever in said deed contained

he the said Charles North yielding and payg unto the said Abraham Pilkington and his assigns during the term of his natural life and after the death of the said Abraham to the said Henry Pilkington his heirs and assigns the yearly sum of five shillings by two even and equal portions or half yearly payments that is to say on every first day of May and first day of November the first payment thereof to be made on the first day of November next ensuing

with the other usual clauses between landlord and tenant as in and by said lease may appear

and which said lease and this memorial are witnessed by Luke Usher of Whitefore and Roger North of Balychristal [sic] both in the King’s county gents
