Deed 1838 7 185 in the Registry of Deeds

Transcription:

A memorial of an indenture made the seventeenth day of April in the year one of our lord thousand eight hundred and thirty eight between between

William Goodwin of Naas in the county of Kildare gentleman and Hannah Goodwin otherwise North (daughter of the late Roger North of Kilduff in the King’s county esquire) his wife of the one part and

George Symes of Dame street in the city of Dublin stock broker of the other part

Reciting that by indenture of lease bearing date the fourth June one thousd seven hundred and ninety six Charles William Bury then of Charleville in the King’s county demised unto the said Roger North all that and those the lands of Cloneen Cloonagh and Mullagharush containing two hundred and ninety eight acres two roods and thirty four perches situate in the lower half Barony of Philipstown and King’s county therein particularly described to hold for the lives of William North James North and Roger North sons of the said lessee or for the term of thirty one years subject to one hundred and fifty eight pounds eight shillings of the then currency

and reciting that the said Roger North died about the month of April one thousand eight hundred and thirty one having first made & published his last will and testament in writing bearing date the nineteenth day of February one thousand eight hundred and twenty nine

and by deed will testator amongst other things therein mentioned demised unto trustees therein named all his estate and interest in and to the aforesaid lands of Cloonagh Cloneen and Mullagharush upon trust for the purposes and subject to the charges therein mentioned

and amongst other things subject to an annuity or yearly rent charge of twenty pounds a year which testator left and bequeathed unto his daughter Hannah Goodwin (party hereto) to be issuing and payable out of the lands of Cloonagh Cloneen and Mullagharush therein before mentioned during her natural life payable on every first day of May and first day of November

and reciting that the said George Symes had contracted and agreed to and with the said William Goodwin and Hannah Goodwin for the absolute purchase of said annuity for the sum of one hundred and fifty pounds

which said indenture of which this is a memorial witnessed that

in pursuance of said agreement and for and in considrn of said sum of one hundred and fifty pounds sterling to the said William Goodwin and Hannah Goodwin his wife paid by the said George Symes

they the said William Goodwin and Hannah his wife and each of them according to their estate and interst therein did grant bargain sell assign transfer and make over unto the said George Symes his exors admors and assigns all that and those the said annuity or yearly rent charge of twenty pounds secured and chargeable upon and issuing and … said lands of Cloonagh Cloneen and Mullagharush situate in the Lower half Barony of Philipstown and King’s county herein before mentioned and all arrears and future payments then for said benefit and advantage given for securing the payment of said annuity and all the estate right title and interst trust property claim and demand whatsoever both at law and in equity or achieved howsoever of them the said William Goodwin and Hannah his wife or either of them or any person in trust for them of into or out of the same premises or any part thereof

to have and to hold receive take and enjoy the said annuity or yearly sum of twenty pounds and all other the premises hereby assigned unto the said George Symes his exors admors and assigns from thenceforth for and during the life of the said Hannah Goodwin and also for and during all and every other the term time estate and interest whatsoever of them the said William Goodwin and Hannah Goodwin or either of them their exors or admors therein or thereto respectively under and by virtue of the said herein before recited will and codicil or otherwise howsoever

to the said George Symes his exors admors and assigns as his and their own proper goods and chattels for ever

which said deed and this memorial according to the execution whereof by the said William Goodwin and Hannah his wife is duly witnessed by James Symes of Dominick street in the city of Dublin attorney at law and Daniel Molloy of Peter street in the said city of Dublin gentm attorney at law

The within mentd James Symes maketh oath and saith that he saw the deed of which the within writing is a memorial and also the said memorial duly executed by William Goodwin and Hannah Goodwin parties thereto and deponent saith that the name James Symes subscribed thereto respecrtively as a witness is this deponent’s name and proper handwriting and that he delivered said deed and memorial to Walter Glascock esquire assistant register at the registry office in the city of Dublin on the eighteenth day of April one thousand eight hundred and thirty eight at or near the hour of twenty minutes to four o’clock in the after noon of said day.
