Transcription:

A memorial of an indented deed of annuity bearing date the ninth day of July one thousand eight hundred and fifty three and made between

the Reverend Joseph North of Shantanagh in the county of Monaghan clerk of the first part

William Gibson of upper Mount street in the city of Dublin esquire of the second part

and Francis Blackburne Martley of Lower Baggot street in the city of Dublin esquire of the third part

reciting as therein said deed witnessed that in consideration of the sum of three hundred pounds sterling paid by the said William Gibson to the said Joseph North he the said Joseph North did grant unto the said William Gibson his executors administrators and assigns one annuity or clear yearly rent charge or annual sum of forty pounds five shillings and six pence sterling to be payable during the life of the said Joseph North and to be charged on the several lands and premises therein and hereinafter mentioned such annuity to be payable by half yearly payments on every tenth day of January and tenth day of July in every year and in proportionate part thereof from the last gate day of the decease of the said Joseph North in case he should die between any of the said gate days

and said deed further witnessed that for the considerations therein the said Joseph North did grant bargain sell and demise unto the said Francis Blackburne Martley his executors administrators and assigns all that and those the town and lands of Kilduffe mearing and bounding to the north with the bog commonly called Mooneweeny to the south with the lands of Barnane to the east with Monenamaddie and to the west with the lands of Cloonagh containing by estimation one hundred and seventy acres situate in the Barony of Philipstown and King’s county and thereby charged with the payment of said annuity   To hold said town lands and premises with the appurtenances unto the said Francis Blackburne Martley his executors administrators and assigns from the day next before the day of the date of said deed for the term of one hundred years provided the said Joseph North should so long live upon trust among others to secure the perpetual payment of said annuity of forty pounds five shillings and six pence as therein mentioned

and said deed contained provisions for the payment of said annuity after the expiration of three years and for the reduction thereof in the event of perpetual payment as therein

which said deed and the memorial as to the execution thereof by the said Joseph North the same one witnessed by Charles F Johnson of the city of Dublin solicitor and by Richard Nolton of Talbot street in the city of Dublin attorney at law

The above named Richard Nolton maketh oath & saith he is a subscribing witness to the deed whereof the above writing is a memorial and also to said memorial saith he saw the said Joseph North duly sign seal & deliver said deed and also saw him duly execute said memorial & saith that the name Richard Nolton subscribed as a witness to the said deed  & memorial respectively is this deponent’s proper name & handwriting and that he delivered said deed & memorial to John E Chapman esqr Assistant Registrar at the public Registry office situate in Henrietta St in the city of Dublin on the eleventh day of July one thousand eight hundred & fifty three at or about the hour of twenty minutes past ten o’clock in the forenoon of sd day

A memorial of an indented deed of annuity bearing date the twenty first day of December one thousand eight hundred and fifty three made between

the Reverend Joseph North of Shantanagh in the county of Monaghan clerk of the first part,

William Gibson of Merrion Square in the city of Dublin esquire of the second part

and Thomas Blackburne Martley of Lower Baggot street in the city of Dublin esquire of the third part

Reciting a certain deed of annuity bearing date the ninth July one thousand eight hundred and fifty three whereby the said Joseph North for the considerations therein granted to the said Francis Blackburne Martley the lands and premises therein and hereinafter mentioned and whereby a term of one hundred years was created for securing said annuity

said deed of which this is a memorial witnessed that in consideration of the sum of three hundred pounds sterling paid by the said William Gibson to the said Joseph North [he the said Joseph North] did grant bargain sell and confirm unto the said William Gibson his executors administrators and assigns one annuity clear yearly rent charge or annual sum of twenty five pounds thirteen shillings and six pence sterling to be payable during the life of the said Joseph North to be charged upon and yearly issuing and payable out of all that and those the town and lands of Kilduff mearing one bounding to the north with the bog commonly called Mooneweeny to the south with the lands of Barnane to the east with Monenamaddle and west with the lands of Cloonagh containing by estimation one hundred and seventy acres more of less situate in the Barony of Philipstown and King’s county to hold receive take and enjoy the said annuity yearly rent charge or annual sum of twenty five pounds thirteen shillings and six pence unto the said William Gibson his executors administrators and assigns for and during the natural life of the said Joseph North payable half yearly on every tenth January and tenth July with power of distress in case of the said annuity should be in arrear for thirty days and also a power to enter into possession of the said lands and premises charged with the payment of said annuity and to receive and take the rents issues and profits thereof to and for his and their own use for payment of the arrears of said annuity

and said deed further witnessed that in the considerations therein the said Joseph North by the direction of the said William Gibson did thereby consent and agree that all that and those the said town and lands of Kilduff situate in the Barony of Philipstown & King’s county and thereby charged with the payment of said annuity should remain vested in the said Francis Blackburne Martley his executors administrators and assigns for and during the said term of one hundred years granted by the said indenture of the ninth July one thousand eight hundred and fifty three provided the said Joseph North should so long live upon the several trusts mentioned and contained in said indenture of which this is a memorial subject to the redemption and to be reduced on the terms therein

which said deed and this memorial as to the execution thereof by the said Joseph North the same is witnessed by Adam Samuel Forster of Northumberland Road in the county of Dublin gentleman and Thomas Travers of Bolton street in the city of Dublin clerk to William Gibson of Merrion Square solicitor.

The abovenamed Adam Samuel Forster maketh oath and saith that he is a subscribing witness to the deed of which the above writing is a memorial and also to said memorial and saith he saw said deed duly signed sealed and delivered and this memorial respectively duly signed and sealed by the above named Joseph North and saith that the name Adam Samuel Forster subscribed as a witness to the execution of said deed and memorial respectively is this deponent’s proper name and handwriting  and saith he delivered said deed and memorial respectively to John Edward Chapman esquire assistant register at the public registry office Henrietta street Dublin on Wednesday the twenty first day of December one thousand eight hundred and fifty three at or near the hour of eight minutes after three o’clock in the afternoon of said day
