Memorial of an indented deed of appointment dated the eighth day of June one thousand eight hundred and fifty four and made between

John Roger North therein described of Corrig Avenue Kingstown in the county of Dublin esquire of the first part

Robert Mulock of Charlemont street in the city of Dublin esq and Isaac Bomford North of Fair view in the county of Westmeath of the second part

John Emerson of number nine Westmorland street in the city of Dublin esquire of the third part

the said Robert Mulock and John Emerson of the fourth part

and Frederick William Niven of Harold’s Cross in the county of Dublin esquire of the fifth part

Reciting an indenture bearing date the sixth of August one thousand eight hundred and forty five made between David North therein described of the first part; Catherine Nash of the second part; the said John Roger North (party hereto) of the third part; Emily Emerson since deceased of the fourth part; Elizabeth Emerson therein also described of the fifth part; the said John Emerson (party hereto) of the sixth part; and the said Robert Mulock and Isaac Bomford North of the seventh part: for the considerations therein mentioned the said David North conveyed and assined [sic] unto the said Robert Mulock and Isaac Bomford North all that and those that part of the lands of the west then in the possession of the said David North or his undertenants containing by Daniel Geraghty’s survey sixty one acres one rood and five perches Irish plantation measure situate lying and being in the Barony of Fortullagh [sic] in the county of  Westmeath to hold the same unto the said Robert Mulock and Isaac Bomford North their heirs and assigns upon the trusts therein mentioned

and further reciting that the said Emily Emerson in and by said said indenture for the considerations therein mentioned conveyed and assined [sic] unto the said Robert Mulock and Isaac Bomford North and their heirs and assigns all that and those that part and parcel of the town and lands of the Island otherwise Clonkeen otherwise Castletown containing in the whole seventy eight acres or thereabouts part whereof being know as the Swang… of Killpatrick situate lying and being in the Barony of Ballycommon and in the Kings county to hold unto the said Robert Mulock and Isaac Bomford North and their heirs upon the trusts therin mentioned

and further reciting that they the said Emily Emerson, John Emerson and Elizabeth Emerson assigned and transferred unto the said Robert Mulock and Isaac Bomford North all that charge or sum of six hundred and seventy six pounds thirteen shillings and four pence of the late currency estimated to the sum of six hundred and fifteen pounds seven shillings and eight pence affecting the lands of Toor in the county of Westmeath together with a sum of one thousand three hundred and eighty four pounds twelve shillings and four pence then invested in the purchase of government three percent consols to hold the same upon the trusts therein mentioned

and reciting that the said Isaac Bomford North was desirous to be discharged from the office of trustee and that the said John Emerson hath agreed to become a trustee in his place.

It witnessed that for the considerations therein mentioned and in pursuance of the power vested in him he the said John Roger North nominated and appointed the said John Emerson to be the trustee in the foom of the said Isaac Bomford North and that they the said Robert Mulock and Isaac Bomford North for the considerations therein mentioned sold and released unto the said John Emerson and his heirs all and every the lands hereditaments and premises in the said in part recited indenture of settlement firstly and secondly described to hold the same upon the trusts therein mentioned in

said indenture further witnessed that the said Robert Mulock and Isaac Bomford North assigned and transferred unto the said Frederick William Nevin [sic] the said charge of six hundred and sixty pounds thirteen shillings and four pence and the said sum of one thousand three hundred and eighty four pounds twelve shillings and four pence upon the trusts therein mentioned ….

Signed sealed and delivered by the said John R North, Isaac Bomford North, John Emerson and Frederick W Niven and Robert Mulock in presence of John Dolan & Robert Byrne

The above named James Dolan maketh oath and saith tht he is a subscribing witness to the deed of which the above writing is a memorial and also to said memorial and saith that said deed and memorial were respectively duly executed by the said John R North, Robert Mulock, Isaac Bomford North, John Emerson and Frederick W Niven in the presence of this deponent and of Robert Byrne the other witness thereto and saith that the name James Dolan subscribed as a witness to to the execution of said deed and memorial respectively is this deponents proper name and hand writing and saith he delivered said deed and memorial respectively to P V Fitzpatrick esquire assistant register in the office for the registration of deeds in Ireland situate in Henrietta street in the city of Dublin on the twenty first day of June one thousand eight hundred and fifty four at twenty six minutes before 12 o’clock in the forenoon of said day

Note: Isaac Bomford North and John Roger North were brothers, sons of David North.  Elizabeth Emerson was the wife of John Roger North, and daughter of Horatio Emerson and Emily Mulock.
