Transcript:

Third day of February one thousand eight hundred and twenty nine made between

John North of Whitewell in the county of  Westmeath esq of the first part

John Roger North late of Whitewell afsd but now of the city of Dublin esq eldest son of the said John North of the second part

and Isaac North of Ferrans in the county of Meath esq Saml Gerrard of Tallyho in the said county of Westmeath esq and John Joshua Pim of Lower Gardiner Street in the city of Dublin  wine merchant of the third part

reciting that the said John North was seized as of freehold for the term of his natural life as therein mentd of all that and those that part of the town and lands of Whitewell therein and herein after mentd

and reciting that the said John North being so seized did by indre bearing date the first day of May one Thousand eight hundred and  ten demise grant set and to farm let unto the said John Roger North all that and those that part or parcel of the lands of Whitewell commonly known by the name of Hopes farm as therein mentioned to hold unto the said John Roger North for the term of the natural life of the said John North party thereto and to the deed of which this is a meml or for the term of thirty one years from thenceforth whichever of said terms should longest last subject to the yearly rent of sixteen pounds late Irish currency payable on every first May and November as therein

and further reciting that the said John North

in order during his lifetime to provide   …   maintenance for the said John Roger North his eldest son and heir …  to the said lands of Whitewell upon his death and to secure as a provision for his three unmarried daughters therein named the sum of seven hundred pounds sterling payable by the said John Roger North and secured by his bond with warrant of attorney for confessing judgment bearing equal date therewith in the penal sum of one thousand four hundred pounds unto the said Isaac North said Gerrard and John Joshua Pim without interest upon the day of the death of the said John North and payable with interest from the day of his death at the rate of six pounds per cent per annum upon the trusts and subject to the provisions therein after mentioned

proposed to grant an annuity or yearly rent charge of twenty four pounds sg to the …. & payable unto the said John Roger North as therein and therein mentioned

said deed of which this is a memorial witnessed that the said John North in consn of the sum of seven hundred pounds stg secured as aforesd & for the consns therein duly given grant bargain sell release and confirm unto the said John Roger North his exors admors and assigns one annuity yearly rent charge or sum of twenty five pounds stl to be charged and chargeable upon and to be paid and payable out of all these and those that part of the town and lands of Whitewell therein the propy of the said John North party thereto or those deriving under him containing in the whole two hundred and forty acres late Irish plantn measure be the same more or less situate lying and being in the Barony of Fartullagh and county of Westmeath aforesd to hold the said annuity unto the said John Roger North his exrs admors and assigns from the first day of November then last for the natural life of the said John North party thereto payable by two half yearly payments one every first on very first day of May and first day of November as therein with power of entry and distress and reentry in case of  non payment thereof as therein mentioned

and said deed further witnessed that for the further securing the said annuity and the payment of the said bond when payable or such part thereof as should become due on  ….  thereof the said John North and John Roger North did resply grant set and to farm let unto the said Isaac North Saml Gerrard and John Joshua Pim and the survr of them his exrs admins and assigns all that and those the land of Whitewell afsd subject as therein mentd to hold for the term of one thousand years at the yearly rent of one pepper corn upon trust interalia in the life time of the said John North to secure the payment of the said annuity by demise sale or mortgage as therein mentioned and from and immediately after the death of the said John North upon trust to call in collect and sue for as therein directed the said principal sum of seven hundred pounds with interest thereon from the death of the said John at the rate aforesd or so much of said principal sum together with interest thereon as should remain due thereon after deducting thereof all arrears of said annuity of twenty five pounds of so much thereof as should be due unto the said John Roger North his exors admors and assigns upon the day of the death of the said John North  & upon the other trusts therein

and as to the said bond it was by said deed ared by said parties that same was prepared upon trust when same should become payable in the first place to direct and allow the trust unto the said John Roger North his exors admors and assigns all arrears of said annuity and after such deduction to call in and recover the residue thereof together with interest therefrom at the death of the said John North at the rate aforesaid and to pay and apply the same and every part thereof to and among the said Deborah North Sophie North and Jane North spinsters therein named or to and amongst  such of them as should be then living in such shares or all to one as the said John North should by deed or will appoint or for want of such appointment then equally to such as should be then living and in case of one only then alive then to such one

and upon further trust that in case all should die without issue in the life time of the said John North then and in such case the said bond and warrant should be given thereupon  …  upon any judgment had thereon as therein mentioned

which said deed as to its execution ….   the said John North and John Roger North and this memorial as to its execution by the said John North are resply witnessed by Jane Hewitt spinster and Richard Hewitt gent and ……..  both of North Fredk Street in the city of Dublin

the above named Richard Hewitt maketh oath and saith that he is a subscribing witness to and was present and saw the original deed whereof the above is a memorial of the deed and above memorial is the deponent’s proper name and handwriting saith he  …..  said the original deed and above memorial to Francis Armstrong esq Deputy Registrar at the office  in the … Quay in the city of Dublin on Friday the eighth day of May last between the hours of eleven and twelve o’clock in the forenoon of sd day
