A memorial of an ind^ed deed of marriage settlem^t bea^g date the 26^th day of April 1808 made between Tho^s Fossett [Thomas Fossett] of Portarlington in the Queen’s county gent of the first part

Sarah North of the city of Dublin spinster of the second part and

George Fossett of Garryvecum in the Queen’s county aforesd esq^r of the third part

reciting that by inde^ed deeds of lease and release the release bear^g date the 17^th day of Feb^y 1803 made between Alderman John Cartelou Rich^d Allen and Th^o Norman three of the com^rs named and impowered in by and in pursuance of sev^l acts of parliam^t passed in Ireland for making wide and convenient streets in the city of Dublin for and on behalf of themselves and the rest of the s^d com^rs their …. and assigns of the one part and Rob^t Frannin [Robert Frannin] of the s^d city cabinet maker of the other part the s^d three com^rs parties thereto did for the consider^s therein ment^d demise and set release and confirm unto the s^d Rob^t Frannin in his actual posⁿ then being by virtue of a bargain and sale in s^d release recited and to his heirs and assigns all that lot or portion of ground on the west side of South Great Georges street therein and herein after more par^ly ment^d To hold with the appurt^s unto the s^d Rob^t Frannin his heirs and assigns from the first day of Nov^r then last for and during the natural lives of their Royal Highness George Prince of Wales Fred^k Duke of York and W^m Henry Duke of Clarence first second and third sons of his present majesty King George the third and for and during the life and lives of every such other person or persons as by virtue of the cov^t for perpetual ren^l therein cont^d sh^d be added to the terms of s^d release at the yearly rent of £20.9.6 payable half yearly above taxes

and rect^g that s^d release

and the prem^es thereby demised were then vested in the s^d Tho^s Fossitt  [Thomas Fossitt]

and recit^g that a marr was then shortly to be had between s^d Tho^s Fossett and s^d Sarah North

which s^d deed of which this is a mem^l witnessed

that for the consid^ns therein ment^d

the s^d Tho^s Fossitt did grant bargain sell release and confirm unto the s^d George Fossitt in his actual possⁿ then being by virtue of a bargain and sale therein recited and to his heirs and assigns all that & those

the afore^sd lott or parcel of ground on the west side of South Great Georges st marked and designated on the s^d com^rs maps

and also on the map to s^d deed of release annexed by N^o2 … in breadth in the front to s^d street 21 feet in breadth in the rere the like number of feet and in depth from front to rere on the north and south sides thereof resp^ly …. feet between s^d sev^l … measurem^ts or tog^r with the rere back dwelling house then recited

and inc^l on s^d lot of ground in part in Great Georges st af^sd w the appurt^s bounded on the north by an other lot of ground in possⁿ of sd Rob^t Frannin demised to him by the s^d com^rs on the west by a …. Lane and on the east by great Georges street afr^sd which s^d premes are situ lying and being in the city of Dublin afore^sd

To hold unto the sd George Fausett his heirs and assigns for the life and lives their s^d Royal Highnesses George Prince of Wales Fred^k Duke of York and W^m Henry Duke of Clarence and the life and lives of them and for the life and lives of each other person and persons as by virtue of the cov^t for perpetual ren cont in s^d deed of release sh^ll forever thereafter be added hereto subject to the rent & cov^t in s^d release recited & cont^d

and it was by s^d deed of which this is a mem^l agreed that the thereby released and assigned prem^es was so released and assigned upon the trust therein ment^d that is to say

to the sole use of s^d Tho^s Fossitt his heirs and assigns until the solemniz^tn of s^d marriage

and from and after that solemniz^tn thereof that he the s^d George Fossitt and his heirs and assigns shall and do pay or permit s^d Tho^s Fossitt and his assigns to receive the rent and profits of s^d prem^es during his life

and after his death to pay or permit s^d Sarah North and her assigns during her life to receive out of the rents and profits of s^d prem^es the clear yearly sum of £40

and in the mean time to pay or permit the heirs & assigns of s^d Tho^s Fossitt to receive the residue of the rents and profits of s^d prem^es

and from the decease of the heirs of the s^d Tho^s Fossitt and Sarah North upon trust to pay or permit the child and children of the s^d Sarah North by s^d Tho^s Fossitt (if more than one) to receive out of the rents and profits of s^d prem^es the s^d yearly sum of £40 to be divided between them if more than one share and share alike and to their heirs and assigns

and in the mean time to pay or permit the heirs of the s^d Tho^s Fossitt to receive the residue of the rents and profits of s^d prem^es

but in case of the death of the s^d Sarah North in the life time of the s^d Tho^s Fossitt without issue at the time of her death upon trust to convey assign and make over s^d pre^mes with the appurt^s unto the s^d Tho^s Fossitt his heirs and assigns

and it was thereby agreed that the provision thereby intended for s^d Sarah North sh^d be in lieu of all dowers and thirds*

which s^d deed of which this is a mem^l is witnessed by George Goss att^y and W^m North [William North] gentleman of the city of Dublin

and this mem^l is witnessed by the s^d W^m North and Ge^o Fossitt jun^r

The above named W^m North maketh oath that he saw the deed of which the above writing is a mem^l duly perfected by all the parties thereto and also saw the above mem^l duly perfected by the above named Tho^s Fossitt and saith dep^t is a sub^g witness to s^d deed and mem^l and dep^t deliv^d s^d deed and mem^l to John Griffin esq^re the 8^th day of Sept^r 1808 at or near half past 12 o’clock at noon.
