A memorial of an inded deed of marriage settlemt beag date the 26th day of April 1808 made between Thos Fossett [Thomas Fossett] of Portarlington in the Queen’s county gent of the first part

Sarah North of the city of Dublin spinster of the second part and

George Fossett of Garryvecum in the Queen’s county aforesd esqr of the third part

reciting that by indeed deeds of lease and release the release bearg date the 17th day of Feby 1803 made between Alderman John Cartelou Richd Allen and Tho Norman three of the comrs named and impowered in by and in pursuance of sevl acts of parliamt passed in Ireland for making wide and convenient streets in the city of Dublin for and on behalf of themselves and the rest of the sd comrs their …. and assigns of the one part and Robt Frannin [Robert Frannin] of the sd city cabinet maker of the other part the sd three comrs parties thereto did for the considers therein mentd demise and set release and confirm unto the sd Robt Frannin in his actual posn then being by virtue of a bargain and sale in sd release recited and to his heirs and assigns all that lot or portion of ground on the west side of South Great Georges street therein and herein after more parly mentd To hold with the appurts unto the sd Robt Frannin his heirs and assigns from the first day of Novr then last for and during the natural lives of their Royal Highness George Prince of Wales Fredk Duke of York and Wm Henry Duke of Clarence first second and third sons of his present majesty King George the third and for and during the life and lives of every such other person or persons as by virtue of the covt for perpetual renl therein contd shd be added to the terms of sd release at the yearly rent of £20.9.6 payable half yearly above taxes

and rectg that sd release

and the premes thereby demised were then vested in the sd Thos Fossitt  [Thomas Fossitt]

and recitg that a marr was then shortly to be had between sd Thos Fossett and sd Sarah North

which sd deed of which this is a meml witnessed

that for the considns therein mentd

the sd Thos Fossitt did grant bargain sell release and confirm unto the sd George Fossitt in his actual possn then being by virtue of a bargain and sale therein recited and to his heirs and assigns all that & those

the aforesd lott or parcel of ground on the west side of South Great Georges st marked and designated on the sd comrs maps

and also on the map to sd deed of release annexed by No2 … in breadth in the front to sd street 21 feet in breadth in the rere the like number of feet and in depth from front to rere on the north and south sides thereof resply …. feet between sd sevl … measuremts or togr with the rere back dwelling house then recited

and incl on sd lot of ground in part in Great Georges st afsd w the appurts bounded on the north by an other lot of ground in possn of sd Robt Frannin demised to him by the sd comrs on the west by a …. Lane and on the east by great Georges street afrsd which sd premes are situ lying and being in the city of Dublin aforesd

To hold unto the sd George Fausett his heirs and assigns for the life and lives their sd Royal Highnesses George Prince of Wales Fredk Duke of York and Wm Henry Duke of Clarence and the life and lives of them and for the life and lives of each other person and persons as by virtue of the covt for perpetual ren cont in sd deed of release shll forever thereafter be added hereto subject to the rent & covt in sd release recited & contd

and it was by sd deed of which this is a meml agreed that the thereby released and assigned premes was so released and assigned upon the trust therein mentd that is to say

to the sole use of sd Thos Fossitt his heirs and assigns until the solemniztn of sd marriage

and from and after that solemniztn thereof that he the sd George Fossitt and his heirs and assigns shall and do pay or permit sd Thos Fossitt and his assigns to receive the rent and profits of sd premes during his life

and after his death to pay or permit sd Sarah North and her assigns during her life to receive out of the rents and profits of sd premes the clear yearly sum of £40

and in the mean time to pay or permit the heirs & assigns of sd Thos Fossitt to receive the residue of the rents and profits of sd premes

and from the decease of the heirs of the sd Thos Fossitt and Sarah North upon trust to pay or permit the child and children of the sd Sarah North by sd Thos Fossitt (if more than one) to receive out of the rents and profits of sd premes the sd yearly sum of £40 to be divided between them if more than one share and share alike and to their heirs and assigns

and in the mean time to pay or permit the heirs of the sd Thos Fossitt to receive the residue of the rents and profits of sd premes

but in case of the death of the sd Sarah North in the life time of the sd Thos Fossitt without issue at the time of her death upon trust to convey assign and make over sd premes with the appurts unto the sd Thos Fossitt his heirs and assigns

and it was thereby agreed that the provision thereby intended for sd Sarah North shd be in lieu of all dowers and thirds*

which sd deed of which this is a meml is witnessed by George Goss atty and Wm North [William North] gentleman of the city of Dublin

and this meml is witnessed by the sd Wm North and Geo Fossitt junr

The above named Wm North maketh oath that he saw the deed of which the above writing is a meml duly perfected by all the parties thereto and also saw the above meml duly perfected by the above named Thos Fossitt and saith dept is a subg witness to sd deed and meml and dept delivd sd deed and meml to John Griffin esqre the 8th day of Septr 1808 at or near half past 12 o’clock at noon.
